    Divorce with Equitable Distribution
Client/Wife and OP/Husband were married in December 2002.  There is a dispute as to the date of final separation as OP alleges that the parties have been separated since 2010 while the client believes that the separation date was November 2014.  Client alleges there were times when the parties got back together after their initial separation. OP initiated a divorce action in November 2012; OP is represented by counsel. There is a hearing scheduled on the date of separation on February 9, 2016.  The marital estate includes OP’s retirement benefits, debt, and motor vehicles.  At the time OP alleges the parties’ final separation occurred, there were two properties owned by client and OP which were subsequently lost to foreclosure actions and sheriff’s sales.   Client is a victim of domestic violence perpetuated by OP.  In January 2015, OP negotiated a 1 year probation plea in connection with the domestic violence charges. Client would like representation at the date of separation hearing, at any subsequent hearing on the division of the marital estate, and to finalize the divorce.
